Jim, as far as I know, yes, anyone can start one. However, it not limited to power, per se' but signal strength. Hence, higher power, smaller antenna and the opposite. But, if YOU do cause interference with the Big Boy stations, it's up to you to rectify that! The FM transmitters I saw, range $2000-$4500, pending what you want. Not sure about lincense and if you can even play music!!!
